8 - TRANSFER OF RISKS
The transfer of risks on the goods takes place from the moment of delivery. Goods travel at the recipient's own risk, and it is the recipient's responsibility to: check the condition and quantity of the goods on receipt, if necessary opening the packages in the presence of the delivery person; in the event of damage or shortages, to make the usual reservations on the transport receipt, specifying the nature of the damage or shortages; notify the carrier of the damage or shortages by registered letter with acknowledgement of receipt within three days, in accordance with article 105 of the French Commercial Code.
9 - RETURN OF GOODS
No return of goods will be accepted without prior agreement. In this case, the items will be returned in their original packaging, carriage paid, to the address communicated to the buyer.
10 - CLAIMS
All claims must be sent to CA33. The procedure for handling complaints is available at reception or on request.
11 - WARRANTY
The TITRIVIN warranty applies exclusively in the event of defects arising from hidden faults. It is strictly limited to the free shipment of products to replace defective products. By express agreement, our warranty does not cover damage in transit or any damages, particularly for personnel costs, loss of earnings, commercial disturbance, etc. TITRIVIN's warranty only applies if the products are stored in conditions that comply with our prescriptions.
12 - FORCE MAJEURE
Fire, floods, heat waves, strikes, wars, supply shortages and any other accidents that prevent or reduce manufacturing and services are considered as force majeure and release CA-33 from the obligation to deliver.
13- PERSONAL DATA
The personal data collected by the Chambre d'agriculture de Gironde as part of the above-mentioned service is necessary for its completion. However, the same data will be used to update the regional Customer Relationship Management database of the Chambers of Agriculture of New Aquitaine, which is accessible to all their employees, and whose purpose is to be able to send you information likely to be of interest to you: regulatory and institutional news, agricultural disasters, services, training... 14 - CLAUSE ATTRIBUTING TO JURISDICTION
In the event of a dispute, before taking any legal action, the parties will seek an amicable settlement. If the dispute persists, only the Bordeaux District Court shall have jurisdiction. This clause applies without prejudice to the jurisdiction clauses contained in the buyer's documents. V6.-.June 2020
